ACCEPTANCE OF TERMS

These Terms govern your use of all products, services, communications, features, apps, technologies, content, websites, and software provided by or related to PM APP and its affiliates (hereinafter the PM APP products, products, or products and services).

You must read these and policies carefully. COMPANY PRODUCTS ARE PROVIDED TO YOU (INCLUDING ANY AND ALL OF YOUR EMPLOYEES, AGENTS, AND CONTRACTORS, AND ANY OTHER ENTITY ON WHOSE BEHALF YOU ACCEPT THESE TERMS (COLLECTIVELY "YOU"), SUBJECT TO THESE TERMS. THESE TERMS ARE ENTERED INTO BY AND BETWEEN PM APP AND YOU, AND YOU ACCEPT THEM BY: (a) DOWNLOADING OR USING ANY PM APP PRODUCTS; (b) COMMUNICATING IN ANY WAY WITH PM APP OR INVOLVING PM APP INCLUDING VISITING ANY WEBSITE INVOLVING PM APP; OR (c) ACKNOWLEDGING AGREEMENT WITH THESE TERMS. YOU ARE PROHIBITED FROM USING ANY PM APP PRODUCTS IF YOU DO NOT AGREE TO THESE TERMS. IF YOU ARE UNDER THE AGE OF EIGHTEEN (18), YOU REPRESENT THAT A PARENT OR LEGAL GUARDIAN ALSO AGREES TO THESE TERMS ON YOUR BEHALF.

PM APP makes no representation that PM APP products are appropriate or available for use in all locations. PM APP products may not be available in your location, and deliverables may vary among locations. You represent and warrant that You are authorized to accept these Terms and agree to indemnify PM APP for any and all violations of these Terms.

PRODUCTS AND SERVICES

PM APP aims to bring people together. As part of this mission, we provide various products and services described below to you. We may provide a personalized experience for you. We may use the data we have - for example, about the connections you make, the choices and settings you select, and what you share and do on to personalize your experience. We may help you find and connect with people, groups, businesses, organizations, and others and may use the data we have to make suggestions for you and others. There can be many ways to communicate using PM APP for example, sending or sharing status updates, communicating messages, photos, video, screensharing and more. You might send messages to a friend or several people, create events or groups, or add content to your profile. We also have developed, and continue to explore, new ways for people to use technology and communicate. We may show you ads, offers, and other sponsored content. Our partners may pay us to show their content to you.

We seek to deploy and maintain systems to detect misuse of our products, harmful conduct towards others, and situations where we may be able to help support or protect the community. If we learn of content or conduct like this, we will take appropriate action - for example, offering help, removing content, blocking access to certain features, disabling an account, or contacting law enforcement. We share data with others when we deem it reasonably necessary when we detect misuse or harmful conduct by someone using one of our products. We work to improve our products. For example, we may analyze data and understanding how people use our products. Our products aim to help you find and connect with people, groups, businesses, organizations, and others. Our products may be global in nature. To do so, we may need to store and distribute content and data in our data centers and systems around the world, including outside your country of residence. This infrastructure may be operated or controlled by PM APP or its affiliates or contractors.

YOUR COMMITMENTS & INTELLECTUAL PROPERTY
As part of using PM APP products, you agree to: You cannot use PM APP products if: We want people to use and enjoy PM APP products, but not at the expense of the safety and well-being of others. You therefore agree not to engage in the conduct described below (or to facilitate or support others in doing so):

If reasonably possible, we may remove or disable content you communicate in violation of these provisions and, if applicable, we may take action against you or your account. We may also disable your account if you repeatedly infringe other people's intellectual property rights. To help support our community, we encourage you to report content or conduct that you believe violates your rights (including intellectual property rights) or our terms and policies.

You grant PM APP a non-exclusive, transferable, sub-licensable, royalty-free, and worldwide license to host, use, distribute, modify, run, copy, publicly perform or display, translate, and create derivative works of your content. This means, for example, that if you communicate a photo on PM APP, you give us permission to store, copy, and share it with others such as service providers that support our service or other PM APP products you use. Even content you delete may persist for a limited period of time in backup copies (though it may not be visible to other users). In addition, content you delete may continue to appear if you have communicated it with others and they have not deleted it. You give us permission to use your name and profile information in connection with ads, offers, and other sponsored content that we may incorporate with our products, without any compensation to you. You give us permission to download and install upgrades, updates, and additional features.

If you use or communicate content covered by intellectual property rights that we have and make available in our products (for example, images, designs, videos, or sounds we provide that you add to content you create or share on PM APP), we retain all rights to that content. You can only use our copyrights or trademarks (or any similar marks) with our prior written permission. You must obtain our written permission (or permission under an open source license) to modify, create derivative works of, decompile, or otherwise attempt to extract source code from us.

DATA & PRIVACY POLICIES

To provide PM APP's products, we must collect and use your personal data. We encourage you to review the privacy choices you have in your settings. You agree to our privacy policy as part of these Terms.

To provide the PM APP products, we must process information about you. The types of information we collect depend on how you use our products, including the following:

As described below, we may collect information from and about the computers, phones, connected TVs and other web-connected devices you use that integrate with our products, and we combine this information across different devices you use. For example, we may use information collected about your use of our products on your phone to better personalize the content (including ads) or features you see when you use our products on another device, such as your laptop or tablet, or to attempt measure whether you took an action in response to an ad we showed you on your phone on a different device.

Advertisers, app developers, and publishers can send us information. Such information may include information about your device, websites you visit, purchases you make, the ads you see, and how you use their services—whether or not you have a PM APP account or are logged into PM APP. We may also receive information about your online and offline actions and purchases from third parties who have the rights to provide us with your information.

Partners may receive your data when you visit or use their services or through third parties they work with. Partners should have lawful rights to collect, use and share your data before providing any data to us.

We may use the information we have in connection with our products, including the following:

We may use the information we have to send you marketing communications, communicate with you about our products, and let you know about our policies and terms. We may also use your information to respond to you when you contact us.

You may have the ability to access, rectify, port and erase your data. We may store data until it is no longer necessary to provide our services and PM APP products, or shortly after your account is deleted - whichever comes first. This is a case-by-case determination that depends on things like the nature of the data, why it is collected and processed, and relevant legal or operational retention needs. If you delete your account, we may delete things you have communicated, such as your photos and status updates, and you won't be able to recover that information later. Information that others have shared about you isn't part of your account and won't be deleted.

We may access, preserve and share your information with regulators, law enforcement or others:

Information we receive about you (including financial transaction data related to purchases made with PM APP) can be accessed and preserved for an extended period when it is the subject of a legal request or obligation, governmental investigation, or investigations of possible violations of our terms or policies, or otherwise to prevent harm. We also retain information from accounts disabled for terms violations for at least a year to prevent repeat abuse or other term violations.

We may share information globally, both internally within the PM APP Companies, and externally with our partners and with those you connect and share with around the world in accordance with this policy. Your information may, for example, be transferred or transmitted to, or stored and processed in the United States or other countries outside of where you live for the purposes as described in this policy. We may rely on the European Commission's adequacy decisions about certain countries, as applicable, and obtain your consent for these data transfers to the United States and other countries.

COOKIES

Cookies are small pieces of text used to store information on web browsers. Cookies are used to store and receive identifiers and other information on computers, phones, and other devices. Cookies help us provide, protect and improve the PM APP products, such as by personalizing content, tailoring and measuring ads, and providing a safer experience. While the cookies that we use may change from time to time as we improve and update the PM APP products, we may use them for the following purposes:

This may occur whether or not you have a PM APP account or are logged in. Other parties may use cookies on the PM APP products to provide services to us and the businesses that advertise on PM APP. One of the ways we use cookies is to show you useful and relevant ads on and off PM APP. You may control how we use data to show you ads using your settings or you may opt out of seeing online interest-based ads from PM APP and other participating companies through the Digital Advertising Alliance in the US, the Digital Advertising Alliance of Canada in Canada, or the European Interactive Digital Advertising Alliance in Europe or through your mobile device settings. Please note ad blockers and tools that restrict our cookie use may interfere with these controls. The advertising companies we may work with generally use cookies and similar technologies as part of their services. In addition, your browser or device may offer settings that allow you to choose whether browser cookies are set and to delete them. SECURITY

PM APP takes security seriously and we aim to take immediate action to address serious security-related problems that involve our products. Please report any suspected security vulnerability in a PM APP product to the PM APP Security Response Team info@portalme.com.

You should contact the Security Response Team if:

Only members of the PM APP Security Response Team, a restricted and carefully chosen group of PM APP employees, will have access to material sent to security email address. No outside users can subscribe to this list.

Please provide as much information about your system and the issue as possible when contacting the list. Any information you share with us about security issues that are not public knowledge is kept confidential unless otherwise required by law. It is not passed on to any third-party without your permission unless otherwise required by law.

UPDATING TERMS

We work to improve our products and develop new products. Therefore, we may need to update these Terms from time to time to accurately reflect our services and practices. Continued use of PM APP's products will constitute agreement to such terms.

SUSPENSION OR TERMINATION

If we determine that you have violated our terms or policies, we may take action against your account to protect our community and services, including by attempting to suspend access to your account or disabling it. We may also suspend or disable your account if you create risk or legal exposure for us or when we are permitted or required to do so by law. Where appropriate, we will notify you about your account the next time you try to access it. If you delete or we disable your account, these Terms shall terminate as an agreement between you and us, but the provisions hereafter (including Limitation of Liability and Disputes) will remain in place.

LIMITATION OF LIABILITY

We seek to provide the best products we can and to specify clear guidelines for everyone who uses them. Our products, however, are provided "as is," and we make no guarantees that they always will be safe, secure, or error-free, or that they will function without disruptions, delays, or imperfections. To the extent permitted by law, we also DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not control or direct what people and others do or say, and we are not responsible for their actions or conduct (whether online or offline) or any content they share (including offensive, inappropriate, obscene, unlawful, and other objectionable content). We cannot predict when issues might arise with our products. Accordingly, our liability shall be limited to the fullest extent permitted by applicable law, and under no circumstance will we be liable to you for any lost profits, revenues, information, or data, or consequential, special, indirect, exemplary, punitive, or incidental damages arising out of or related to these Terms or the PM APP products, even if we have been advised of the possibility of such damages. Our aggregate liability arising out of or relating to these Terms or the PM APP products will not exceed the greater of $100 or the amount you have paid us in the past twelve months.

DISPUTES

We try to provide clear rules so that we can limit or hopefully avoid disputes between you and us. If a dispute arises, however, it's useful to know up front where it can be resolved and what laws will apply.

For any claim, cause of action, or dispute you have against us that arises out of or relates to these Terms or the PM APP products ("claim"), you agree that it will be resolved exclusively in the U.S. District Court for the Northern District of California or a state court located in Fresno County. You also agree to submit to the personal jurisdiction of either of these courts for the purpose of litigating any such claim, and that the laws of the State of California will govern these Terms and any claim, without regard to conflict of law provisions.
